This Resolution requires that candidates selected as the interim CEO and as other board members nominated by the Mayor will be subject to background checks prior to taking office.  That background check will be performed by an independent contractor.  The background check shall include: a state and national criminal background check; a verification of post-secondary education and work experience; and, a credit check.

Any expense associated with those background checks shall be charged to account 701-3753 - Pennichuck acquisition.

Resolution R-11-111 declared duly adopted by the Board of Aldermen on September 27, 2011.

On October 4, 2011 the Mayor exercised her veto power on Resolution 11-111 which would have required background checks on candidates selected as the interim CEO and other board members nominated by the Mayor prior to taking office.

Again, this background check would have been performed by an independent contractor and included a state and national criminal background check; a verification of post-secondary education and work experience; and, a credit check.

The Mayor has indicated that the City’s own Human Resources Department has been instructed to conduct the background checks.

I prefer to have an independent contractor perform this service…not because the City can’t or is incapable of conducting a background check; but instead because I want complete transparency in the process — especially with such a potentially historic transaction in having the City of Nashua acquire all outstanding shares of Pennichuck Corporation.

I will be asking for the Board of Aldermen to override the Mayor’s Veto at this evening’s meeting.
